2024 Holiday Season Closure

Development Services (Building and Planning Division)

The Municipality of Kincardine Municipal Administration Centre is closed from noon on December 24th, 2024 to January 2nd, 2025 at 8:30 a.m.

Any inspections requested during this time will be filed with the Administrative Assistant at 519-396-3468 ext. 7124. All inspection requests shall be requested a minimum 2 days in advance of the scheduled closure in accordance with Section 1.3.5.3 for Prescribed Inspections under the Ontario Building Code.

Except as provided in Sentence (2), an inspector or registered code agency, as the case may be, shall, not later than two days after receipt of a notice given under Sentence 1.3.5.1.(2), undertake a site inspection of the building to which the notice relates.

Where a notice given under Sentence 1.3.5.1.(2) relates to matters described in Clause 1.3.5.1.(2)(l) or (m), an inspector or registered code agency, as the case may be, shall, not later than five days after receipt of the notice, undertake a site inspection of the sewage system to which the notice relates.

When undertaking an inspection required under Sentence (1) or (2), the inspector or registered code agency, as the case may be, may consider reports concerning whether the building or a part of the building complies with the Act or this Code.

For greater certainty, when undertaking an inspection required under Sentence (1) or (2), the inspector or registered code agency, as the case may be, may choose to not attend at the physical site of the building and may instead undertake the inspection using other means.

The time periods referred to in Sentences (1) and (2) shall begin on the day following the day on which the notice is given.

The time periods referred to in Sentences (1) and (2) shall not include Saturdays, holidays and all other days when the offices of the principal authority are not open for the transaction of business with the public.

Despite Sentence (5), the time periods referred to in Sentences (1) and (2) include days when the offices of the principal authority are not open for the transaction of business with the public if the reason given by the principal authority for the offices not being open is related to coronavirus (COVID-19).

Changes to the Ontario Building Code and National Farm Building Code of Canada

The Province of Ontario has released the 2024 Ontario Building Code which comes into effect on January 1st, 2025. Completed applications received until December 1st, 2024, will be subject to the 2012 Ontario Building Code.

Certain transitional guidelines are included for applicants whose working drawing were substantially complete by December 31, 2024. 

By April 1st, 2025, all permit applications must be submitted using the 2024 Building Code.

Release of the 2024 Edition of Ontario's Building Code

The province's new Building Code looks to reduce regulatory burdens for the construction industry, increase the safety and quality of buildings, and make it easier to build housing.

The new code is streamlining processes for the building sector and increasing harmonization with the National Construction Codes through the elimination of at least 1,730 technical variations between the provincial and national requirements.

Updates to the National Farm Building Code

The updates to the National Farm Building Code will be released January 1, 2025, harmonizing with the National Building Code of Canada. Farm buildings will be captures in Part 2 of the 2024 Ontario Building Code.

With this, new farm buildings and additions will be subject to Code classifications under Part 2 of the Ontario Building Code. These will categorize farm buildings based on their hazard classifications.

  • G1 - High Hazard
  • G2 - Agricultural Occupancies not classified in Group G
  • G3 - Greenhouses
  • G4 - Agricultural Occupancies with no human occupants

Municipal and County Development Charges

Municipal and County Development Charges are increasing January 1, 2025 under By-Law 2021-114. This applied to all qualifying development projects as outlined in our Legislative Services Guide on Development Charges.

The County of Bruce has implemented a county-wide Development Charge under their By-Law 2023-048 which is subject to a multi-year phase-in. It is applicable to qualifying development projects within the Municipality of Kincardine.
