Draft Comprehensive Zoning By-Law Available for Review and Comment

Working alongside MHBC Planning, the Municipality of Kincardine are updating the Comprehensive Zoning By-law. The draft is on the agenda for the upcoming October 23rd Council meeting and ready for review online.

“A project of this magnitude has involved extensive hours and staff resources. Seeing the evolution of this document has definitely put the project into perspective” commented Dwayne McNab, Manager of Development Services and Chief Building Official (CBO) for the Municipality.

“The current by-law is 21 years old, and the needs of the community have changed over the past two decades. We’ve diligently worked through this project, making over 10,000 changes to the document.”

Staff began the review in late 2021 following the update and adoption of a new official plan. The Planning Act required to amend all Zoning By-Laws within a 3-year period following the revision of an official plan.

Public meetings and consultations have been foundational throughout the project and guided the process, resulting in the current draft and it is associated mapping. Another set of upcoming meetings will give the community even further opportunity to share their thoughts before a finalization.

Open houses offering the opportunity for discussion are set for Tuesday, October 29th, 2024, from 2 to 4 in the afternoon, and again that same evening from 5 to 7 p.m. at the Municipal Administration Centre at 1475 Concession 5 in Kincardine.

Then, on Wednesday, November 13th, 2024, there will be a Public Meeting at 5 p.m., also held at the Municipal Administration Centre.

“The information is online for people to review as they have time or they’re welcome to visit us in the Development Services division at the Municipal Administration Centre in Kincardine to view a copy in person,” continued McNab.

“We’re here to help folks understand the proposed changes and how it may affect them. Reviewing in advance then attending the open house or public meeting with specific questions and comments is a great way to do this. There’s also opportunity to submit feedback online until November 22, 2024.”

The Zoning By-Law is a legal document that details land use through regulations and permissions. It classifies properties into categories like residential, commercial, and industrial, with each of those zones having specific permissions associated.

The purpose of the open house and public meeting is to complete a comprehensive update to the Municipality of Kincardine’s local Zoning Bylaw. The Zoning Bylaw is a legal document that specifies how land can be used through regulations (property setbacks, building heights etc.) and permissions (residential, commercial, agricultural, etc).

The Municipality’s current Zoning Bylaw is 21 years old. The purpose of the comprehensive review is to ensure that the Zoning Bylaw reflects the updated Official Plan, current practices, changes to provincial policy, and supports the strategic directions of the Municipality.

The Draft Zoning By-law will be available on the Comprehensive Zoning By-Law webpage after it has been presented to council on October 23rd, 2024.

On the day of and during the Public Meeting you can participate in person or virtually. The commenting period will close November 22, 2024.

The Public meeting will be held in a hybrid format (virtual or in-person) at the Municipal Administration Centre located at 1475 Concession 5 Kincardine.
