Notice of Passing of Area-Specific Development Charges By-Law
TAKE NOTICE that on Wednesday, March 26, 2025, the Council of The Corporation of the Municipality of Kincardine passed By-law No. 2025-034 under Section 2 of the Development Charges Act, 1997, with respect to area-specific development charges rates for the Highway 9/21 Business Park Lands.
AND TAKE NOTICE that any person or organization may appeal to the Ontario Land Tribunal under Section 14 of the Act in respect to the by-law by filing with the Clerk of The Corporation of the Municipality of Kincardine, not later than Monday, May 5, 2025, a notice of appeal setting out the objection to the by-law and the reasons in support of the objection.
The charges in the aforementioned by-law will apply to all new residential and non-residential development in the Highway 9/21 Business Park Lands, subject to certain terms, conditions and limited exemptions as identified therein.
The development charges are levied against new development in the Highway 9/21 Business Park Lands to pay for the increased capital costs related to the provision of such area-specific municipal services as storm water infrastructure, sanitary sewer, watermains, roads and related and associated financing costs. The area-specific development charges imposed by the by-law are as follows:
Development Charge per Net Hectare $236,151
Development charges are imposed on the development of all lands located within the geographic boundary of the Highway 9/21 Business Park Lands as identified in the key map shown below.

The land area based development charge rates are in effect as of March 26, 2025. Copies of the complete development charges by-law are available for examination in the offices of the Municipality located at 1475 Concession 5, R.R. #5, Kincardine, ON, N2Z 2X6 and on the website.
